On February 23, 2011, Judge Dunlap of Howell Co., Missouri Court ruled against Morningland, despite expert testimony that the test results of Morningland's cheese did not indicate a presence of anything harmful to humans. Ignoring the expert testimony, the judge also stated, "the court must... disregard the absence of sickness among the consumers of defendant's cheeses."
All of Morningland's cheese has been ordered to be destroyed, Morningland has been ordered to pay court costs, and also to make several changes, at considerable expense, to the cheese plant before resuming making cheese.

We believe that the information Judge Dunlap used for his decision was incomplete, and we intend to submit a request for him to reconsider his judgment. If the judge refuses to reconsider, we shall then appeal his decision.
