Rebuttal/Remedy Response to Milk Board, & Press Release - Oct. 6, 2010

Dear Morningland customers, friends, et al,

On Friday, October 1st, 2010, Morningland Dairy received from the Missouri State Milk Board several memorandums and a letter that ordered the destruction of ALL of Morningland's cheese. Today we are sending a formal but brief objection to several of the statements made in these memorandums and the destroy order, as well as a proposed remedy. We have also issued a press release and are contacting the appropriate governmental agents with all of this information and asking them for their assistance.

Subject: Family Run Dairy Ordered to Destroy 50,000 Pounds of Cheese

Subheading: Battle Over Raw Dairy Products Has a New Epicenter

Morningland Dairy has issued an objection to the Missouri Milk Board’s “order to destroy” their inventory of raw aged cheese. The cheese is being held on their property under an embargo issued by the Missouri Milk Board on August 26th, 2010. The embargo on all Morningland’s product was issued in response to tests done by the California Department of Food and Agriculture on cheese seized in a raid on Rawesome Foods in Venice, Ca. on June 30th. The embargo halted all production and sales of Morningland cheese.

Missouri Milk Board gave Morningland a verbal order of destruction on September 24th. Joseph Dixon, owner and General Manager of Morningland, then requested that Gene Wiseman, Executive Secretary of the Missouri Milk Board, provide written notice of the order to destroy and the method of destruction. Wiseman wrote the order to destroy on October 1st and it was hand delivered by Don Falls of the Missouri Milk Board to Morningland Dairy on October 1st, but it did not include the destruction procedures.

Denise Dixon, owner and General Manager of Morningland Dairy says, “Morningland has been producing raw aged cheese for 30 years, and in that time, absolutely no reports of illness have been made by anyone who has consumed our product. We are, and remain, wholly committed to providing good, healthful food to our customers. The order to destroy 50,000 or so pounds of our cheese is not associated with even one complaint of illness, and we believe it’s an over reaction at best.”

In their objection to the destruction order, Morningland offers a remedy based on sound and verifiable scientific testing. Denise Dixon says, “It is our hope that reason and common sense will prevail. Until that happens, it appears that the State of Missouri and the FDA are more interested in putting us out of business than allowing consumers to have a choice in their food.”

At this point there is no written assurance from the Missouri Milk Board indicating that Morningland will be allowed to resume production or distribution of their products.

Today I have contacted the following on behalf of Morningland. I suggest all readers do the same, remembering to be respectful, yet state you complete disgust over the appalling and unfair ruling that has been made.

We need to stand up for the unfair practices that are causing such difficulty for "our" dairy. Remember to remain respectful, while being firm.

Most of all, we can pray for God to right all of the wrongs that are being done in this situation.

How often do you sample your cheese products for possible pathogen contamination? Do you have a preventative sampling program in place?

Morningland has always performed the state-required tests required, which are: 1) for presence of antibiotics (performed on milk for each batch of cheese made), 2) for a somatic cell count (performed on milk by field man 4 times in a 6-month period); and, 3) for a platelet count (performed on milk by field man 4 times in a 6-month period.) In our proposed remedy to the Milk Board, we have stated that we will perform a microbial test, which is not required by the state, nor is standardly performed, on each batch of cheese that we plan to sell, in order to identify any contamination, and will offer for sale only cheese batches that are found to be free of contamination,

It doesn't seem the issue is with the milk. It appears to be with the cheese. What preventative sampling program is in place for the actual cheese? Lm & S.aureus is commonly spread by people to the finished product. What monitoring procedures are in place to monitor pathogen presence or growth on the cheese (not the milk)?

This again makes me so MAD! I don't know for sure but you should look into the 4th branch of government called administrative law. I don't know much about it but heard a lot things that should looked at strongly by everybody.

Is there an organization formed to represent those being injured in these FDA cases? One on one, these small farms won't stand a chance. I sympathize with this problem, have donated to your cause, but feel it is futile unless your efforts are well organized and coordinated.
If in fact, the FDA is not abiding internal policy in their efforts to reach over-arching objectives, then, as is evident, the small farmers will have to protect themselves. Local authorities, even if individual officials are sympathetic, will be forced on the side of the FDA due to politics, (keeping their jobs) and federal authority.
You small farmers will have to unite, be intelligent and be bold. Corporations are clearly purchasing policy in Washington and in order to preserve freedom for each other, you will have to stand together and persistently strive to pull down this power.
Within these enormous companies are self interested individuals wielding billions in marketing, lobbying, legal and propaganda dollars. They are hiring our best and brightest to reach business objectives and they are very good at it. They are also inserting people of their choosing into slots in Washington by financing their campaigns. This is of course not the intent of capitalism, but a certain outcome if the people are not aware and do not properly oversee their government, but suppose innocently that the government will protect them.
I will write and I will call, but please, organize yourselves. If you already have, please send information so that I can stay informed.
